THE ST. LOUIS BIG BAND

"DRUG-FREE WORKPLACE POLICY" (Amended March 25, 2013)

I.    We all must recognize that illegal drug use and illegal consumption of alcohol negatively affects "The St. Louis Big Band"  (The Band), the employee's and independent contractor's job performance.   In this regard,  The Band has adopted this "DRUG-FREE WORKPLACE POLICY",  effective immediately.

While we hope that this policy protects and benefits The Band,  The Band's employees should The Band ever choose to hire employees,  and independent contractors who perform service for The Band. 

We hope this policy creates a safe and efficient work environment.

For the purpose of clarification;

-This policy prohibits the illegal consumption of alcohol,  at any Band work or practice sites,  by any Band employee or independent contractor.
-This policy prohibits any and all consumption or possession of illegal drugs and/or illegal substances,  at any Band work or practice sites, by any Band employee or independent contractor.

-This policy prohibits any and all consumption or possession of alcohol, illegal drugs and/or illegal substances at any Band work or practice sites,  by any Band employee or independent contractor,  who has not yet reached the age of majority and is not permitted by law to consume or possess alcohol.
Medicine which has been prescribed by a licensed health care provider or physician, when taken as prescribed by a licensed health care provider or physician, is NOT prohibited under this policy.

II.  IMPAIRMENT PROHIBITED:
No employee or independent contractor shall report for work or practice, or work while impaired by alcohol, illegal drugs and/or illegal substances.

Medicine which has been prescribed by a licensed health care provider or physician and which is taken as prescribed by a licensed health care provider or physician, is NOT prohibited. 

“Impaired” means under the influence of alcohol, illegal drugs and/or illegal substances which impairs, or may be reasonably presumed to impair,  judgment or motor senses (i.e., sight, hearing, balance, reaction, reflex, etc.).

III. POSSESSION PROHIBITED:
The Band's employees or independent contractors are strictly forbidden from possessing or consuming any illegal drugs and/or illegal substances,  at any Band work or practice sites.   
The Band's employees or independent contractors who have not reached the age of majority and are not permitted by law to consume alcohol, are strictly forbidden from possessing alcohol, illegal drugs and/or illegal substances, at any Band work or practice sites.

Medicine which has been prescribed by a licensed health care provider or physician and which is taken as prescribed by a licensed health care provider or physician, is permitted at any time and at any work or practice site.
Medicine should be kept in the original container in which it was dispensed by the licensed pharmacy, health care provider or physician, or should be accompanied by a written prescription or written orders issued by a licensed pharmacy, health care provider or physician.  If this is a problem, please speak to RYAN SHEEHAN, The Band's Director,  and accommodations will be made for you.

"Work site” means any office, building, or property (including parking lots) owned, operated or used by The Band, or any other site at which an employee or independent contractor practices or performs work  for The Band. 

“Possess” means to have any illegal drugs and/or illegal substances, (including alcohol with regard to a minor person who has not  yet reached the age of majority and is not legally permitted to drink alcohol), either in or on an employee or independent contractor's person,  personal effects, motor vehicle, tools, musical instruments, equipment and areas entrusted to the employee or independent contractor,  such as The Band's desks, files, equipment and vehicles.

No person shall be discriminated against or punished in any way for bringing violations of  The St. Louis Big Band's,  "DRUG-FREE WORKPLACE POLICY"  to the attention of RYAN SHEEHAN, Director of The St. Louis Big Band.

Any violation of The St. Louis Big Band's,  "DRUG-FREE WORKPLACE POLICY",  may result in discipline of the  offending employee or independent contractor, including, but not limited to,  immediate discharge or immediate termination of contract.

The St. Louis Big Band's,  "DRUG-FREE WORKPLACE POLICY",  may be amended at any time,  by RYAN SHEEHAN, The Band's Director,  without notice.
